Scott Adams serves as VP, Legal & Compliance North America for Volvo Financial Services in Greensboro, North Carolina. He has experience structuring, negotiating and documenting a variety of commercial transactions, as well as managing bankruptcy and insolvency matters. A native of Charleston, W.Va., he attended Colgate University and WVU College of Law.

Robert S. Cohen is a Partner at Moritt Hock & Hamroff LLP, with offices located on Long Island and in New York City. With over 26 years of experience in all facets of the equipment leasing and asset based lending industries, Bob's practice is devoted to commercial litigation, creditors' rights, corporate transactions and bankruptcy matters. Bob has particular experience in the documentation of financial transactions, enforcement of equipment leases and secured loans, as well as the negotiation of workouts and resolutions. He frequently serves as a speaker and author on various topics relating to the leasing industry.

Bob devotes a significant portion of his time as an active member of ELFA, serving on its Credit and Collections Management Committee, as well as participating as a presenter at its various conferences, including its 2013 Legal Forum Conference, and 2012 and 2011 Credit and Collections Conferences where he served as a speaker at sessions on litigation strategy, electronic discovery, forbearance agreements, lease/secured transaction documentation and legal updates in the finance industry. He is also an active member of NEFA, serving on both its Legal and Education Committees and participating as a presenter at its annual conferences.

In 2012, Bob also presented at the Association of Commercial Finance Attorneys' CLEW Conference. In addition to his professional endeavors, Bob is an active supporter of the Special Olympics of New York-Long Island Region, where he has served as a Chairman of its Annual Gold Coast Tour for Champions Golf Outing for the past eleven years.


Dominic Liberatore

Dominic A. Liberatore is the Deputy General Counsel for DLL, a global provider of leasing and business finance solutions, including vendor finance.

Mr. Liberatore has been practicing law for 35 years focusing on leasing and asset based lending, and has served in a variety of senior in-house legal positions with DLL, IOS Capital, Inc. (the captive finance subsidiary of IKON Office Solutions, Inc.), Copelco Financial Services Group, Inc. and the FDIC. Prior to going in-house, Mr. Liberatore was an associate at Cravath, Swaine & Moore in New York City and Wolf Block in Philadelphia. Mr. Liberatore is a past chairman of the ELFA Legal Committee, current ELFA Subcommittee Coordinator and a past chairman of the Subcommittee on Leasing of the Uniform Commercial Code Committee of the ABA Business Law Section. Mr. Liberatore is also a member of the Editorial Review Board for the Journal of Equipment Lease Financing.

Mr. Liberatore holds a J.D. from Vanderbilt University and a B.A. from the University of Buffalo.


Spencer Mierzejewski



Spencer Mierzejewski has been with eOriginal, and now by way of acquisition, Wolters Kluwer, for six years. In his current role, he focuses on consulting and advising customers on the use of eOriginal’s software to facilitate secondary market transactions electronically, including rated securitizations, warehouse and collateral lines, and unique origination models. Previously, he founded a managed-cost legal company, and also worked in the legal group at Under Armour. Spencer is a graduate of the University of Baltimore School of Law.

Outside of work, Spencer enjoys the ‘low impact’ exercise of pulling his three children around the neighborhood in a wagon and supporting his wife’s career as a mentor for her elementary school students.

Ernest Tsorvas

Fifth Third Bank, National Association


Ernie Tsorvas is National Sales Manager of Fifth Third Equipment Finance (FTEF), a division of Fifth Third Bancorp.  With assets of $7.2B, FTEF is the nation’s ninth largest bank finance or leasing company.  Tsorvas joined FTEF in October 2015 after nearly 25 years with GE Capital, where he held roles in operations, asset management, risk, sales, marketing, sales management, program management and region management.  His industry experience includes direct origination, vendor origination, equipment finance, fleet finance, capital markets and wholesale floor planning.

Tsorvas holds a BSBA from Northeastern University, an MBA from Sacred Heart University and an Executive Certificate in Strategy and Innovation from the Massachusetts Institute of Technology.

Ernie has been a member of the ELFA Financial Institutions Business Council Steering Committee since 2018 and currently serves as Committee Chair.

David Whitaker

David Whitaker is counsel in the Chicago, office of BuckleySandler LLP. Mr. Whitaker advises financial services companies in transactional, legal and regulatory matters. Mr. Whitaker's practice also focuses on assisting firms in their efforts to structure and implement platforms and processes that conform to the requirements of the Electronic Signatures in Global and National Commerce Act (ESIGN), the Uniform Electronic Transactions Act (UETA), other applicable state and federal laws, and various industry standards.

Mr. Whitaker is one of the co-authors of The Law of Electronic Signatures (West), and is one of the contributing authors for the Consumer Financial Services Answer Book 2016 (PLI). He was the Co-Reporter for the Standards and Procedures for electronic Records and Signatures ("SPeRS"), served as Reporter for a white paper for the Mortgage Bankers Association and was the co-author of an article appearing in the Spring 2015 issue of the Journal of Equipment Lease Financing.

Mr. Whitaker is a member of the American Law Institute. He was named a "2009 Mortgage Banking Technology All-Star" by Mortgage Banking Magazine. In 2014, he received both the e-SignLive e-Sign Ambassador Award and a Cornerstone Award from the Electronic Records and Signatures Association. He received a second Cornerstone Award in 2015. Mr. Whitaker holds a B.A. with High Honor in International Relations from James Madison College at Michigan State University, and a J.D. from the University of Illinois (cum laude).

Why did ELFA decide to make the Bank Best Practices Roundtable virtual in 2021?
